MINUTES OF THE MEETING OF 13th OCTOBER 2009

PRESENT:
Councillor Norman Bull (Town Mayor) - in the Chair
Councillors: Jim Anderson (Arrived 7.07pm), Deborah Biss, Kay Charlton, Colin England, Nick Mothershaw, Mick Nelson, Mick Potter, Mark Robertson, Martin Tomlinson.
In Attendance: Mrs Rosalind Bullimore (Clerk) County Councillor Chris Jackson, Sgt. Booth, one member of the press (Belper News).
  1. APOLOGIES FOR ABSENCE
    Apologies for absence were received from Councillors Alan Cox, Jackie Cox and John Nelson (holidays) Kevin Hallsworth (Work Commitments).
  2. ORDER OF BUSINESS
    RESOLVED to present the certificates to the winners of the East Midlands in Bloom competition prior to receiving the Citizens Advice Bureau presentation.
  3. DECLARATIONS OF INTEREST
    Councillor Jim Anderson declared a prejudicial interest in minute number 1495 - Drop Inn Centre grant application 288 and left the room whilst the item was discussed. Councillor Kay Charlton declared a prejudicial interest in minute number 1495 - Belper Town Wind Band grant application 293 and left the room whilst the item was discussed. Councillor Mick Potter declared a prejudicial interest in minute number 1477 - Belper Marlin Swimming Club funding request and remained in the room whilst the item was discussed.
  4. TO DETERMINE WHETHER ANY ITEMS SHOULD BE TAKEN WITH THE PUBLIC EXCLUDED
    In accordance with Section 1(2) of the Public Bodies (Admission to Meetings) Act 1960, in view of the confidential nature of the business to be transacted, it was RESOLVED that, in the public interest, the public and press be excluded from the meeting during discussion of Part ll of the agenda Exempt Items and they be instructed to withdraw.
  5. PUBLIC PARTICIPATION
    Emma Hagger a representative from the Mid-Derbyshire Citizens Advice Bureau gave a short presentation. Following the presentation she agreed to furnish the Council with a profile of where the clients attending the Belper branch reside.
  6. POLICE
    Sgt. Booth reported that the main problems experienced in Belper are with antisocial behaviour and with alcohol related incidents. The police have had good results with catching offenders causing damage to vehicles on Nottingham Road. The Teen Shelter on Whitemoor Lane has been removed and the area will be monitored to assess the impact its removal may have on the surrounding areas.
    Following a request from a member of the Council at the September meeting Sgt. Booth was unable to give any satisfactory answer as to why a police vehicle was driving down a one way street in the wrong direction at speed.
    Sgt. Booth agreed to check when the last speed survey was carried out on Belper Lane.
  7. COUNTY COUNCIL BRIEFING
    Councillor Chris Jackson reported that the new initiative introduced to deal with the minor road repairs is working well.
    Councillor Biss thanked Councillor Jackson for looking into the traffic problems at Milford.
  8. MINUTES OF A MEETING OF BELPER TOWN COUNCIL HELD 8 SEPTEMBER 2009
    RESOLVED to agree as a true record Minutes 1429 - 1465 of the Council Meeting held 8 September 2009 subject to one amendment Councillor Mick Nelson was not present at the meeting.
  9. MAYORS ANNOUNCEMENTS
    Forthcoming events/Notices etc.
    Councillor Norman Bull reported on various topics and events.
    1. The Borough Council has identified the far end of Bargate Recreation Ground as a suitable plot of land for allotments. Councillor Bull will be distributing a letter and a plan of the area to the Bargate residents to ask for their views on the proposal.
    2. The demolition of the Scout Hut at St. John's Chapel will start Tuesday 20 October and subsequently the car park will be closed for two weeks.
    3. The Showmen will not be overwintering in the Coppice car park this year as they have found an alternative site.
    4. Temporary Road Closure - Shaw Lane, Milford - Mondays to Fridays between 08.00hrs and 15.30hrs outside 8 Shaw Lane to outside 23 Shaw Lane for the rebuilding of a retaining wall from 19 October to 20 November.
    5. Attended the Wirksworth Civic Service 11 October 2009.
    6. Will be attending;

  10. FINANCE
    RESOLVED:
    1. To note and agree income and expenditure incurred in the months of September covering transactions 3473 - 3629. Schedules are attached to these Minutes showing Income of £1,141.37 and Expenditure of £17,049.81.
    2. To note the bank reconciliation for current/public reserve accounts as at 31 August 2009.
    3. RESOLVED to note the external auditor's certificate and opinion in the annual return year ended 31 March 2009 and to adopt the auditor's recommendations.
    4. RESOLVED to adopt the 2009/10 National Final Salary Award.
  11. PLANNING APPLICATIONS
    RESOLVED to note the planning applications listed on the schedules dated 8 September 28 September, 29 September - 12 October.
    RESOLVED Clerk to invite the Chairman of the Borough Council Planning Board to the November meeting to explain and discuss planning matters.
    RESOLVED Clerk to place an item on the November agenda 'To appoint Planning Coordinators'
  12. GRANT APPLICATIONS
    288 - Drop Inn Centre
    RESOLVED to grant an award of £3,000 to the Drop Inn Centre.
    292 - Vitalise
    RESOLVED to grant an award of £150.50 to Vitalise.
    293 - Belper Town Wind Band
    RESOLVED to grant an award of £300 to Belper Town Wind Band.
  13. REPRESENTATIVES ON OUTSIDE BODIES FOR 2009/10
    Friends of Belper Parks
    Councillor Biss reported on the Kite Flying Event held 26 September 2009.
  14. EAST MIDLANDS IN BLOOM
    RESOLVED to note Belper received a Silver Award in the East Midlands in Bloom competition.
  15. CITIZENS ADVICE BUREAU
    RESOLVED to note the Mid Derbyshire Citizens Advice Bureau AGM will be held 20 October 2009.
  16. DENBY VISITORS CENTRE CALENADR OF EVENTS
    RESOLVED to note and approve the Denby Pottery calendar of events 2009/2010.
  17. BELPER TOWN COUNCIL COMMITTEE STRUCTURE
    RESOLVED to remove the Licensing Committee, add the Larks in the Park Committee and add St Georges Day Celebrations to the Christmas Committee. To remove the Borough Council representatives from the Wakes Committee and the Belper Food Committee.
  18. DERBYSHIRE FIRE AND RESCUE SERVICE
    RESOLVED to note the invitation to attend the Derbyshire Fire and Rescue Service focus group 19 October.
  19. DERBYSHIRE COUNTY COUNCIL OPERATION RELENTLESS
    RESOLVED to note the six week initiative of the Safer Neighbourhoods Policing Teams where they will be dealing with antisocial behaviour and addressing any local concerns. Councillors to notify the Clerk of any areas in Belper which could benefit with this service.
  20. TREES AT ST. JOHN'S CHAPEL
    RESOLVED Clerk to forward the letter received from a local resident onto St Peter's Church for them to consider the request for a risk assessment be carried out on the trees in the grounds at St. John's Chapel.
  21. SUSTAINABLE COMMUNITIES ACT
    RESOLVED to note the request of support of the Sustainable Communities Act Amendment Bill.
  22. CILCA SECTION 7 POWER OF WELLBEING
    RESOLVED to note the Council congratulated the Clerk on achieving Section 7 Power of Wellbeing, of CILCA 2008.
  23. RECYCLING BANK, GREYHOUND PUBLIC HOUSE
    RESOLVED to note the letter received from the Borough Council in response to a letter from the Clerk regarding the loss of the recycling site at The Greyhound Public House, Whitemoor Lane and the request for increased facilities at Bargate. Clerk to inform the Borough Council of the new landlord's willingness for additional recycling facilities at Bargate.
  24. STREET NAME PLATES
    RESOLVED to note the letter received from Cabinet Member Councillor Jack Brown in response to a letter from the Clerk regarding the large number of missing Street name Plates in Belper.
  25. DERBYSHIRE COUNTY COUNCIL YOUNG ACHIEVER AWARDS 2009.
    RESOLVED to note the request for nominations for the Derbyshire County Council Young Achievers Awards 2009.
  26. HMS BROCKLESBY
    RESOLVED to note the letter received from Lieutenant Commander Adam F Northover the new Commanding Officer of HMS Brocklesby and to invite him to Belper in the near future.
  27. SLCC TRAINING DAY
    RESOLVED Clerk to attend the SLCC training day.
  28. B6013 FAR LAUND SPEED LIMIT CONSULTATION
    RESOLVED the Council would like the speed limit to remain at 40mph as there has never been any significant problem on this stretch of road to warrant any changes.
  29. LOCAL COMMUNITY FORUM
    RESOLVED to note the date of the next Community Forum meeting is 3 November 2009.
  30. BELPER MARLIN SWIMMING CLUB
    RESOLVED to donate £40 for the sponsor of two events at the Belper Marlins Open Meet Gala 25 October 2009.

    RESOLVED To note the items for information included in the agenda and the schedule attached to these minutes.
  32. EXEMPT ITEMS
    1. STAFF APPRAISALS
      RESOLVED to delegate Councillor John Nelson and Councillor Mick Nelson to appraise and review the Clerks performance. Councillors are requested to suggest targets and objectives for the Clerk's future performance.
      Following the Clerk's assessment the Clerk will arrange for the remaining staff to be assessed.
    2. LOCAL GOVERNMENT PENSION SCHEME
      RESOLVED to authorise the transfer of a private pension fund into the Local Government Pension Scheme.
    3. SUB CONTRACTING OF STAFF
      RESOLVED to approve Council staff to carry out work for other Parish Council's. Clerk to request a job specification and the Finance Working Party to set a fee for the work to be carried out.
