MINUTES OF THE MEETING OF 8th DECEMBER 2009

PRESENT: Councillor Norman Bull (Town Mayor) - in the Chair

In Attendance: Mrs Rosalind Bullimore (Clerk) County Councillor Peter Makin, Sgt. Booth, PC Bower, three members of the public and two members of the press (Belper News and Belper Express).
  1. APOLOGIES FOR ABSENCE
    Apologies for absence were received from Councillor Mick Potter (illness) Kevin Hallsworth (work commitments).
  2. ORDER OF BUSINESS
    RESOLVED to discuss parking enforcement and Belper traffic problems during the County Council's briefing.
  3. DECLARATIONS OF INTEREST
    There were no declarations of interest received.
  4. TO DETERMINE WHETHER ANY ITEMS SHOULD BE TAKEN WITH THE PUBLIC EXCLUDED
    In accordance with Section 1(2) of the Public Bodies (Admission to Meetings) Act 1960, in view of the confidential nature of the business to be transacted, it was RESOLVED that, in the public interest, the public and press be excluded from the meeting during discussion of part ll of the agenda Exempt Items the reimbursement of election expenses and they be instructed to withdraw.
  5. PUBLIC PARTICIPATION
    Councillor John Nelson was presented with the Chief Scout Commendation for Good Service Award, for the excellent work he has carried out in the community.
    A member of the public presented the Council with a breakdown of a budget for the proposed children's project on the Parks Estate in support of agenda item 15 Fleet Art grant application.
  6. POLICE
    Sgt Booth updated the Council on the recent successful events held in Belper 'Lock Up' crime prevention event held at Morrison's Supermarket and the Belper School concert.
    PC Bower informed the Council of the new initiative 'Operation Thurne' a scheme to ensure members of the public are more aware of shop lifters and pick pockets during the lead up to Christmas. Dedicated police officers will be in the town where they will be watching out for theft, daytime revellers, antisocial behaviour and vehicle crime.
    Sgt. Booth agreed to investigate the issues raised by the Council:
    Vandalised fence at the Greyhound Public House, Whitemoor.
    Vandalised litter bins on Nottingham Road.
    Motorist's driving through the pedestrian area on King Street.
    Antisocial behaviour problems on the Parks Estates.
    Funding for a teen shelter at Milford.
    Burglaries in the Clusters area.
    The Council congratulated the police force in general, for their recent successful Automated Number Plate Recognition campaign in the area.
  7. PARKING AND TRAFFIC PROBLEMS
    Councillor Peter Makin explained the complex ruling with regards to vehicles parking on pavements. If a vehicle is parked on double yellow lines it is the parking enforcement officer's responsibility. The only time the police have any authority to deal with a parking offence is when a vehicle is causing an obstruction or is considered to be dangerous.

    RESOLVED to agree as a true record Minutes 1498 - 1518 of the Council Meeting held 10 November 2009 subject to the following amendments minute number 1500 Councillor Alan remained in the room because no discussion took place with regards to the item he had declared an interest in. Minute number 1505 should read 1513 and the following numbers be amended to follow on in numerical order.
  9. MINUTES OF AN EXTRAORDINARY MEETING OF BELPER TOWN COUNCIL HELD 24 NOVEMBER 2009
    RESOLVED to agree as a true record Minutes 1519-1525 of the Council Meeting held 24 November 2009 subject to the following amendments 1524 irrespective of the Councils decision to attach a letter signed from the BATS group as an appendix to the town council's response on the SPD - Land between the A6 and the River Derwent consultation, the Council are not associated and have no intention of associating with the BATS group.Minute number 1525 Improve vehicular access to the Brief Site amend to read - to improve the general flow of traffic, the residential and pedestrian environment and to add the wording to protect and enhance the market town status.
  10. MINUTES OF A CHRISTMAS MEETING HELD 3 NOVEMBER 2009
    RESOLVED to note Minutes 1282 - 1291 of the Christmas Meeting held 3 November 2009 subject to adding Councillor Miller and removing Councillor Charlton from the attendance list. The Council congratulated and thanked the council staff for the excellent work carried out this year with regards to the festival and the spectacular Christmas light displays.

    RESOLVED to note Minutes 23 - 29 of the Larks In The Park Meeting held 9 November 2009
  12. MAYORS ANNOUNCEMENTS
    Forthcoming events/Notices etc.
    Councillor Norman Bull reported on various events.
    1. Belper District 50+ Forum Festival Morning to be held Friday 18 December 2009 at the Belper Town Football Club.
    2. Belper Town Council Carol Service to be held 24 December 2009 7.45pm at the Chapel and 8.00pm on the Market Place.
    3. Attended the Remembrance Day Service 11 November 2009 and he was disappointed there was no vicar in attendance to take the service.
    4. Attended the Oakleaf Remembrance Service 15 November 2009 at the Derby Cathedral.
    5. Attended the Milford Christmas Light 'Switch On' 27 November 2009.
    6. Attended the Christmas Dinner at the Belper Club for Disabled 5 December 2009.
  13. FINANCE
    RESOLVED:
    1. To note and agree income and expenditure incurred in the month of November covering transactions 3921 - 4003. Schedules are attached to these Minutes showing Income of £2,356.46 and Expenditure of £8,637.48.
    2. To note the bank reconciliation for current/public reserve accounts as at 30 October 2009.
  14. PLANNING APPLICATIONS
    RESOLVED to note the planning applications listed on the schedules dated 11November 2009 - 23 November 2009.
  15. GRANT APPLICATIONS
    295 - Fleet Arts
    RESOLVED to grant an award of £2,000 to Fleet Arts towards a children's project at the Belper Children's Centre, on the Parks Estate. Clerk to request an attendance report to be submitted to the Council on completion of the project.
  16. REPRESENTATIVES ON OUTSIDE BODIES FOR 2009/10
    Belper Cottage Project
    Councillor Jackie Cox informed the Council the building is being well used for people with a real need.
  17. COMMERCIAL PARKING IN THE COPPICE CAR PARK
    A member of the public requested permission to park his commercial vehicle in the Coppice car park RESOLVED not to set precedence and allow commercial parking in this car park the space is required for visitors to the town centre.
  18. SUSTAINABLE COMMUNITIES ACT
    RESOLVED to note the Sustainable Communities Act Amendment Bill.
  19. BUS SHELTERS
    RESOLVED not to take on the maintenance of two bus shelters outside the Whitemoor Medical Centre. Clerk to write to the Environmental Services to request they concentrate on implementing the road safety planning condition issues.
  20. SDP LAND BETWEEN THE A6 AND THE RIVER DERWENT CONSULTATION.
    RESOLVED to note no date has been set for the Borough Council Planning Department to consider the comments received from the consultation.
  21. AMBER VALLEY SUSTAINABLE COMMUNITY STRATEGY 2009 -2014
    RESOLVED to note the Sustainable Community Strategy 2009 - 2014 is open for comments until 11 December 2009.
  22. MILFORD VILLAGE STORE POST BOX
    RESOVED Clerk to write a letter to the Post Office in support of the Milford Village Stores request for a Post Box to be erected near the Store.
  23. GRIT BINS
    RESOLVED to maintain the new grit bins provided in Belper by the County Council.
  24. LICENCE COMMITTEE
    RESOLVED to reinstate the licence committee.
  25. SIGNAGE AT SHIREOAKS
    RESOLVED to note the copy of a letter sent to the County Council from a member of the public regarding signage at Shireoaks.
  26. CAR BOOT SALES
    RESOLVED to note and approve the Belper Leisure Centre car boot sale dates for 2010.
  27. BRIDGE HILL LAND
    RESOLVED to note the Council's purchase offer on the land at Bridge Hill for use as allotment space has been rejected.
  28. BARGATE RECYCLING FACILITIES
    REOLVED to note the letter received in response to the Clerks letter with regards to additional recycling facilities at Bargate.
  29. ITEMS FOR INFORMATION
    RESOLVED To note the items for information included in the agenda and the schedule attached to these minutes.
  30. EXEMPT ITEMS
    The decision of Amber Valley Borough Council not to refund the overcharge of by-election expenses was noted. RESOLVED delegation was given to the clerk, in consultation with the Chairman of the Finance Working Party, to take further steps in an attempt to recover the overcharge.
